CRITERIA FOR PROVING ECONOMIC SOLVENCY*

*(Applicable to the regimes established under Law No. 6984/22 and Law No.

3565/08)*

*Article 1. Purpose*

The purpose of this Annex is to establish the criteria, conditions, and

evidentiary means for proving economic solvency as an admissibility

requirement for permanent residency applications, defining the assessment

and verification parameters to be applied by the National Directorate of

Migration.

Its provisions shall apply to permanent residency applications processed

under Law No. 6984/22, *“Migration Law,”* and Law No. 3565/08, *“Approving

the Residence Agreement for Nationals of the MERCOSUR Member States.”*

*Article 2. Nature of the Economic Solvency Requirement*

Economic solvency constitutes an admissibility requirement for permanent

residency, the purpose of which is to demonstrate the existence of lawful,

sufficient, and verifiable means of support that enable the applicant’s

subsistence within the national territory.

Such economic solvency must be demonstrated through appropriate,

sufficient, and verifiable documentation evidencing the effective

generation of income or the actual availability of financial resources, in

accordance with the criteria established in this Annex.

The assessment of economic solvency shall be carried out by the National

Directorate of Migration at the time of the permanent residency

application, considering the consistency between the profession, activity,

or occupation declared by the applicant when applying for temporary

residency and the documentation submitted to prove their actual economic

situation.

Economic solvency shall not be presumed under any circumstances and must be

proven through the evidentiary means established for each category in this

Annex.

*Article 3. General Criteria for Documentary Assessment*

Documentation submitted to prove economic solvency must:

a) Be consistent with the profession, activity, or occupation declared in

the Temporary Residency application, without prejudice to duly

substantiated updates or changes at the time of applying for Permanent

Residency.

b) Allow for the objective verification of the existence of actual income

or means of support.

c) Be valid and duly updated.

d) Be legalized or apostilled and, where applicable, translated into

Spanish.

The National Directorate of Migration may require additional or

supplementary documentation whenever deemed necessary for proper

verification of the information provided.

*Article 4. Categories for Proving Economic Solvency*

Economic solvency may be demonstrated through the following categories:

   1. Professionals;

   2. Technicians;

   3. Employees;

   4. Self-employed workers (trade and services);

   5. Remote workers or digital nomads;

   6. Real estate owners;

   7. Shareholders or partners of legal entities, including Simplified

   Joint Stock Companies (EAS);

   8. Farmers or livestock producers;

   9. Religious workers;

   10. Retirees or pensioners;

   11. Dependents; and

   12. Students.

*Article 5. Professionals*

Applicants invoking this category must submit a university professional

degree duly registered and endorsed by the Ministry of Education and

Sciences (MEC).

They must also prove the effective practice of their profession and the

generation of income by submitting a duly certified copy of any of the

following documents:

   1. Proof of insurance coverage with the Social Security Institute (IPS);

   or

   2. Employment contract endorsed by the Ministry of Labor, duly approved

   and registered.

   3. VAT returns for the last three (3) months or Personal Income Tax

   (IRP) return for the most recent fiscal year, together with a Tax

   Compliance Certificate, demonstrating actual economic activity.

Possession of a professional degree alone shall not constitute sufficient

proof of economic solvency.

*Article 6. Technicians*

Applicants invoking this category must submit a technical degree duly

registered and endorsed by the MEC.

They must also prove the effective practice of their technical occupation

and the generation of income by submitting a duly certified copy of any of

the following documents:

   1. Proof of insurance coverage with the IPS; or

   2. Employment contract endorsed by the Ministry of Labor, duly approved

   and registered.

   3. VAT returns for the last three (3) months or Personal Income Tax

   (IRP) return for the most recent fiscal year, together with a Tax

   Compliance Certificate, demonstrating actual economic activity.

Possession of a technical degree alone shall not constitute sufficient

proof of economic solvency.

*Article 7. Employees*

Applicants invoking this category must submit any of the following

documents:

   1. Proof of insurance coverage with the Social Security Institute (IPS);

   or

   2. Employment contract endorsed by the Ministry of Labor, duly approved

   and registered.

*Article 8. Self-Employed Workers (Trade and Services)*

Applicants invoking this category must submit:

a) Proof of taxpayer registration and Proof of Natural Person Registration;

b) VAT returns for the last three (3) months or Personal Income Tax (IRP)

return for the most recent fiscal year, together with a Tax Compliance

Certificate, demonstrating actual economic activity.

*Article 9. Remote Workers or Digital Nomads*

Applicants invoking this category must submit:

   1. A certificate or employment verification letter supporting the

   employment relationship and indicating the income received, as well as the

   method through which fees or salary are paid; or

Documents issued abroad must be duly legalized or apostilled and translated

into Spanish.

*Article 10. Real Estate Owners*

Applicants invoking this category must submit a property title registered

with the General Directorate of Public Registries (currently the National

Unified Registry – RUN), with registration having occurred within the

previous two (2) years.

The administrative authority may require additional documentation

demonstrating income generated from the property.

*Article 11. Shareholders or Partners*

In the case of corporate shareholders, applicants invoking this category

must submit any of the following documents:

   1. Certified copy of the company’s articles of incorporation, duly

   registered with the General Directorate of Public Registries (currently the

   National Unified Registry – RUN), expressly identifying the applicant as a

   shareholder; or

   2. Certified copy of the shareholders’ register books registered with

   the General Directorate of Public Registries (currently the National

   Unified Registry – RUN), or an electronic certificate identifying the

   applicant as a shareholder.

For EAS (Simplified Joint Stock Companies), applicants invoking this

category must submit a certificate issued by the General Directorate of

Legal Entities, Legal Structures and Ultimate Beneficial Owners (DGPEJBF).

*Article 12. Farmers and Livestock Producers*

Applicants invoking this category must submit one of the following:

   1. Property title dedicated to productive activities, registered with

   the General Directorate of Public Registries (currently the National

   Unified Registry – RUN), together with a Tax Compliance Certificate and

   Proof of Natural Person Registration.

   2. Documentation evidencing the purchase/sale of production or a

   registered livestock or production brand, together with a Tax Compliance

   Certificate.

*Article 13. Religious Workers*

Applicants invoking this category must submit:

a) Certification from the MEC confirming the registration of the religious

congregation; and

b) A letter from the congregation or institution certifying the function

performed and assuming responsibility for living expenses.

*Article 14. Retirees or Pensioners*

Applicants invoking this category must submit a retirement or pension

certificate indicating the amount received and the financial institution or

method through which payments are received.

Such documents must be duly legalized or apostilled.

*Article 15. Dependents* *1) Spouses*

Where one spouse is financially supported by the other, the applicant

invoking this category must submit:

a) Marriage certificate duly legalized or apostilled; and

b) Certified copy of the Paraguayan identity document or residence card of

the supporting spouse.

*2) Parents or Grandparents*

Where they are financially supported by their children or grandchildren,

the applicant invoking this category must submit:

a) Documentation proving the family relationship; and

b) Certified copy of the Paraguayan identity document or residence card of

the financial supporter.

*3) Persons with Disabilities*

Where they are financially supported by a relative up to the second degree

of consanguinity in the ascending line (parents or grandparents), second

degree in the collateral line (siblings), or third degree in the collateral

line (uncles and aunts), the applicant invoking this category must submit:

a) Disability Certificate issued by the National Secretariat for the Human

Rights of Persons with Disabilities (SENADIS), or by the competent

authority of the country of origin, duly legalized or apostilled;

b) Documentation proving the family relationship; and

c) Certified copy of the Paraguayan identity document or residence card of

the financial supporter.

*Article 16. Students*

This category includes adults (18 years of age or older) who are enrolled

in primary, secondary, or higher education (universities or higher

institutes), whether through in-person, distance-learning, or virtual

modalities, and who maintain regular immigration status in accordance with

applicable laws and regulations.

*In-Person Education*

Applicants pursuing studies in Paraguay through in-person education must

submit the following documents, regardless of educational level:

a) Certificate of enrollment or official document issued by the educational

institution certifying regular student status.

b) Documentation demonstrating academic continuity.

c) Proof of payment of enrollment fees, tuition fees, or academic records

evidencing continued studies during the two (2) years of temporary

residency, in accordance with the applicant’s declaration.

*Distance or Virtual Education*

Applicants aged 18 years or older residing in Paraguay and pursuing studies

through distance-learning or virtual education must submit the following

documents, regardless of educational level:

a) Certificate of enrollment specifying that the applicant is a regular

student in a distance-learning or virtual education program, issued by the

educational institution (whether located in Paraguay or abroad; if abroad,

the document must be apostilled or legalized and accompanied by an official

Spanish translation).

b) Proof of payment of enrollment fees, tuition fees, or academic records

evidencing continued studies during the two (2) years of temporary

residency, in accordance with the applicant’s declaration.

Student status alone shall not constitute sufficient proof of economic

solvency for a permanent residency application. Therefore, the applicant

must additionally demonstrate the availability of sufficient means of

support through appropriate and verifiable documentation proving:

   1. The existence of their own income; or

   2. In the case of students financially supported by a relative up to the

   second degree of consanguinity in the ascending line (parents or

   grandparents), second degree in the collateral line (siblings), or third

   degree in the collateral line (uncles and aunts), the applicant must submit:

a) Documentation proving the relationship with the financial supporter.

b) Documentation evidencing the effective provision of financial resources

in their favor, such as transfers, deposits, remittances, or other

verifiable means.

c) Certified copy of the identity document of the financial supporter.
